Healing Manor Hotel – Firework Display Terms and Conditions

Healing Manor Hotel Fireworks Display is subject to the following terms and conditions:

• Event Date – Sunday 3rd November 2023
• Event Timings - Gates open at 4pm Firework Display starts at 6.45pm.
• Tickets are non-refundable.
• Ticket holders should note that Healing Manor Hotel and their partners and other authorised persons may have film cameras present at the event. By entering the site and/or purchasing tickets, ticket holders consent to filming and sound recording which may include you as a member of the audience and its use in distribution commercial or otherwise perpetually and without any payment.
• In case of emergency please follow instructions and directions from stewards, staff and/or other officials.
• Strobe lighting may be in use during the event.

Further information
• The Firework Display will take place in most weather conditions and will only be cancelled in the event that we are advised that it is unsafe to go ahead. In the very unlikely event that the event is cancelled, we regret that we are unable to provide a refund to pre-purchased tickets and an alternative date will be provided.
• Your safety and security is important to us and every step will be taken to ensure that the event is run with this in mind. In order to facilitate the security, safety and comfort of all our patrons, the site reserves the right in its reasonable discretion to conduct security searches of persons, clothing, bags and all other items on entry and exit and to confiscate items which may cause danger or disruption to the event with no refunds please note that we are not responsible for any prohibited items or other items that we deem inappropriate or unsafe that are confiscated. Please take the time to read through the following Event Restrictions & Prohibited Items.
• Signposting will be on display throughout the ground on the night of the event. Please take the time to familiarise yourself with our safety zones, emergency exits, first aid locations, lost children’s zones etc.
• Car parking is restricted and we request that you park in accordance to the law, in the surrounding areas, paying respect to our friends and neighbours. Do not park on grass verges, and please do not park inf ront of peoples driveways, or restrict access.
• Event Restrictions - The following information sets out our policy on behaviour and restrictions as to what can be brought to the event. This is designed to ensure the health and safety of all our patrons and your adherence to the policy will speed up the process on entry and ensure that everyone has a fun time at the event.
o No Re-Entry
There is no re-admission to the event after entry. Please plan ahead. Once you are in, you are in!
o Group ticket bookings must arrive together. If you have booked tickets for more than one person, you must all enter together, as once your ticket is scanned, the system will register your full group as being present.
o No Large Umbrellas, Golf Umbrellas or Parasols
o No Chairs, Stools - This event is a standing only event and these items are not permitted for safety reasons. Seat sticks are permitted for those requiring seating and a number of seating will be made available on the evening. This will be in designated zones.
o Buggies/Pushchairs
These are permitted but we would ask you to consider parking a buggy in a less densely populated area as in large crowds it may prove difficult to push a buggy and may cause a safety risk. You may be asked to relocate a buggy if a steward deems it a safety risk. Please also note that a large proportion of the grounds is grass, meaning ground areas can become muddy and boggy.
o No Animals
Animals, except for assistance dogs, are not permitted at any time on the day of the event.
o Cigarettes and smoking
We will not be selling cigarettes and there is no re-entry during the event so bring what you need for personal use only. Smoking cigarettes or electronic cigarettes is not permitted in tents or marquees and only in outside areas. Please dispose of cigarette buds responsibly.
o Waste bins are provided throughout the site. You must use these to dispose of rubbish.
o Behaviour
Illegal and antisocial behaviour will not be tolerated and will lead to ejection from the event.

Challenge 25
If you are lucky enough to look under 25, we may ask you to prove your age when entering the event or when attempting to buy alcohol as part of our Challenge 25 Alcohol Policy. Any one of the following is considered an acceptable form of ID:

1. Passport not a photocopy. Foreign passports are acceptable if in a suitable condition and include a photograph.
2. Full or provisional photo card driving license issued by the DVLA.
3. Proof of Age Card – the card must be part of the PASS scheme and carry their hologram.

If you are under 18 you are committing an offence if you attempt to buy alcohol. Similarly, anyone purchasing alcohol for someone under 18 is committing an offence.

Prohibited Items
In order to facilitate the security, safety and comfort of all our patrons, the site reserves the right in its reasonable discretion to conduct security searches of persons, clothing, bags and all other items on entry and exit and to confiscate items which may cause danger or disruption to the event with no refunds please note that we are not responsible for any prohibited items or other items that we deem inappropriate or unsafe that are confiscated.

The following is an example list but not exhaustive of prohibited items :

• Food, drinks and alcohol, other than what is purchased on site
• Large umbrellas
• Chairs, stools
• Dangerous or hazardous items
• Flags, banners and poles
• Glass of any kind
• Fire or fireworks, Chinese lanterns
• Bicycles, skateboards and scooters
• Spray cans
• Air horns, klaxons or similar items capable of making a loud noise
• Laser pens
• Gas canisters
• Hand held communication devices, such as radios, radio jammers/scanners etc
• Suitcase, large rucksacks/bags
• Alcohol save that purchased at the event
• Illegal substances & New Psychoactive Substances legal highs

Specific Requirements for Access
1. If You have access requirements for the Event please You can let Us know by one of the following options: by emailing reception@healingmanorhotel.co.uk or by telephoning 01472 884544 .**You must have made Your ticket purchase for this Event before Your request can be processed.
2. If You have not notified the Healing Manor Hotel of Your access requirements in advance we will do our upmost to ensure that we will be able to cater to Your needs, although we will use reasonable endeavours to do so.
3. Please note that accessible car parking spaces must be pre booked, to guarantee parking on site, due to the limited number of car parking spaces available.

Tickets, Times, Refunds and Cancellation
1. Only customers holding a valid Ticket will be admitted to the Event. There are a limited number of Tickets available for the Event, and therefore purchase of Tickets is strictly subject to availability on a first come first served basis subject to timed batch releases.
2. Tickets are not transferrable and cannot be exchanged.
3. Tickets are only valid for the viewing areas and entrance points specified on the ticket.
4. You must always retain the Ticket on Your person during the Event, be it electronically or physically.
5. Your Ticket may be invalidated if any part of it is removed, altered, or defaced.
6. Upon purchase, please check Tickets carefully as mistakes cannot always be rectified after purchase. Refunds will not be made on returned Tickets.
7. Healing Manor Hotel will not be responsible for any Ticket that is lost, stolen, or destroyed. You are solely responsible for the safekeeping of Your Ticket. It is Your responsibility to notify Collins, Tonic of any issues in this regard and no later than two working days before the event.
8. Ownership or possession of a Ticket does not confer any rights by implication or otherwise on You to use, alter, copy, or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the Ticket.
9. Tickets are sold subject to the Healing Manor Hotel's right to alter or vary the published Event programme. Healing Manor Hotel is not obliged to offer refunds or exchanges due to any such changes.
10. All advertised times are approximate and subject to change. It is Your responsibility to make appropriate arrangements to ensure that You arrive at the viewing area in sufficient time in case the Event starts early and to ensure that You are able to stay until the close of the Event should You wish to if it overruns. Healing Manor Hotel will not refund or meet the costs of any alternative travel or accommodation arrangements or be responsible for any loss of enjoyment or other indirect loss as a result of an Event not running to the advertised times.
11. In the event of a cancellation or postponement of the Event purchased tickets will be transferrable, but not refundable.
12. Whilst Healing Manor Hotel will do its upmost to communicate any changes, it is Your responsibility to check that the Event has not been cancelled or rescheduled. Information on such matters will be made available on behalf of Healing Manor Hotel as soon as reasonably practicable on Healing Manor Hotel’s website and/or social media.

Unauthorised Ticket Agents
1. The Tickets You have purchased are for Your personal use only.
2. The resale of Tickets, either by unauthorised agents or public second selling by whatever means is strictly prohibited and in breach of these Terms & Conditions.
3. This no second selling policy will be rigorously monitored and enforced in all on-line and other forums and at the event.
4. Should there be a breach of these Terms and Conditions by You Healing Manor Hotel are entitled to cancel the Tickets without prior notification, refund, compensation or liability to You or any third party. The barcode on these cancelled tickets will be made null and void so that they cannot be used to enter the event.
5. Healing Manor Hotel reserves the right to refuse admission to, or eject from, the viewing area anyone using or attempting to use Tickets obtained in breach of these Terms and Conditions and subsequently made null and void. Any person seeking to use a void Ticket in order to gain or provide entry to the Event will be ejected and may be liable to legal action.
6. Tickets bought from unauthorised agents are unlikely to be valid.
7. Healing Manor Hotel will be unable to assist You if You have bought from an unauthorised source, as we will have no purchase history available for the Ticket.
8. Void Tickets are non-refundable.
9. Your Tickets will be barcoded and the name of the lead Ticket purchaser will be printed on the front of each, therefore if You have booked more than one Ticket, Your group will need to arrive together. You may as the Ticket purchaser, must bring photo identification, as You may need to show it when Tickets are scanned at the entrance points.

Liability
1. You agree that the Healing Manor Hotel will not be liable for any loss, injury or damage to any person including Yourself or property however caused a in any circumstances unless due to the negligence of Healing Manor Hotel, its staff and/or contractors; b in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach save for death or personal injury due to the negligence of the Healing Manor Hotel, its staff and/or contractors; or c to the extent that any increase in any loss or damage results from the breach by You of any of these Terms and Conditions.
2. Healing Manor Hotel will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure. For the purposes of these Terms and Conditions, "Force Majeure" means any cause beyond the Healing Manor Hotel’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, worldwide, national or local pandemic, national defence requirements and/or acts or regulations of national or local governments.
3. You agree that the Healing Manor Hotel shall not be liable to You for any indirect or consequential costs, claims, actual or alleged losses howsoever arising out of or in connection with the Event and/or the Healing Manor Hotel's obligations hereunder including but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation, or loss of contract or other economic or consequential loss arising from the performance or any failure to perform these Terms and Conditions.
4. Healing Manor Hotel will not have any liability to You whatsoever for loss or expenses incurred in connection with the Event or any cancellation of the Event, including, without limitation, costs of any personal travel, accommodation or hospitality arrangements made relating to the Event or the cancellation of the Event.
General
1. To the fullest extent permissible in law, Healing Manor Hotel shall be entitled to assign all and any of its rights and obligations under these Terms and Conditions, provided that Your rights are not adversely affected.
2. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provisions and remainder of these Terms and Conditions valid or enforceable.
3. If Healing Manor Hotel delays or fails to enforce any of these Terms and Conditions it shall not mean that it has waived its right to do so.
4. Any person, other than the Healing Manor Hotel, who is not a party to these Terms and Conditions shall have no rights under the Contracts Rights of Third Parties Act 1999 to enforce any term of these Terms and Conditions.
5. Nothing in these Terms and Conditions and no action taken by You or Healing Manor Hotel under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between You and Healing Manor Hotel.
6. These Terms and Conditions constitute the entire agreement between the parties in connection with the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between You and Healing Manor Hotel relating to the subject matter of these Terms and Conditions.
7. Nothing in these Terms and Conditions shall purport to exclude liability for fraud or fraudulent misrepresentation.
8. These Terms and Conditions shall be governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
